Judge Rules Governor Wolf's Shutdown Orders Unconstitutional

Elections matter especially as our country struggles in the throngs of a growing civil war.

The judiciary was never supposed to be so involved in political decision making, but with the lefts’ inability to win at the ballot box and with them using CV-19, even with its very loa and targeted death rate, to override the Constitutional rights of US citizens the judges become very important.

And with the judges becoming more important, who the President is also taking on more weight every four years.

A federal judge struck down Gov. Tom Wolf’s pandemic restrictions that required people to stay at home, placed size limits on gatherings, and ordered “non-life-sustaining” businesses to shut down, calling them unconstitutional.

U.S. District Judge William Stickman IV sided with plaintiffs that included hair salons, drive-in movie theaters, a farmer’s market vendor, a horse trainer, and several Republican officeholders who sued as individuals.

Stickman, an appointee of President Donald Trump, wrote in his ruling that the Wolf administration’s pandemic policies have been overreaching, arbitrary, and violated citizens’ constitutional rights. If more judges respected our rights contained in the Constitution and Bill Of Rights, the too would put freedom ahead of junk science.

The governor’s efforts to slow the spread of the coronavirus “were undertaken with the good intention of addressing a public health emergency,” Stickman wrote. “But even in an emergency, the authority of government is not unfettered.”

In addition, the risk of dying from CV-19, for those under 75, is less than getting killed in an automobile accident.  Thus there is no imminent danger to the population, giving the state temporary police powers, thus the Construction is in full force.

Courts had consistently rejected challenges to Wolf’s power to order businesses to close during the pandemic, and many other governors, Republican and Democrat, undertook similar measures as the virus spread across the country.

Wolf has lifted many of the restrictions since the lawsuit was filed in May, allowing businesses to reopen and canceling a statewide stay-at-home order.

Yet, for possibly political purposes, has maintained capacity restrictions and limitations on alcohol sales at bars and restaurants. The state has also imposed a gathering limit of more than 25 people for events held indoors and more than 250 people for those held outside.

A spokesperson for Wolf said the administration was reviewing the decision but in the current climate, might not at the Supreme Court, like Nevada and California just a month ago.

Pennsylvania, with a population of 12.8 million (2019) has reported that more than 145,000 people statewide have contracted the virus since the beginning of the pandemic. More than 7,800 people have died many with but some because of CV-19.

The CDC’s number has the rate of those who died as a result of the virus as low at 6 percent, and most of them over 80.

It’s time for Americans to live Freely, to take responsibility for their own lives, and if those who have unlying health issues want to stay home to wear a mask, the more power to them.

The healthy must never again, lose their freedoms over the risk to a few, and as centuries past, we will again be the Land Of The Free and Home Of The Brave.
